科目概要
行政に関する具体的な課題を通じて，行政法の基礎概念を学ぶ。行政裁量や法律による行政といった解釈法上の重要項目とともに，民間委託，行政規制，社会福祉，および都市計画などの公共政策に関連する事項も取り扱う。また，最新のトピックとして，ドローンや自動運転車などの交通政策もテーマに設定する。電子政府などの最新の課題についても解説を行う予定である。現行法の仕組みや紛争を考察することによって，今後のあるべき法政策の方向性を検討する。
To learn the basic concept of administrative law through examining specific issues concerning administration. In this course, we consider important items such as administrative discretion and administration by law. It also deals with matters relating to public policy such as private consignment, administrative regulation, social welfare, and urban planning. In addition, as the latest topic, we will set the theme of transportation policies such as drones (UAV) and autonomous vehicles (UGV). We will also explain new issues such as e-government. We examine the future direction of legal policy by analyzing disputes and current law systems.

主題と目標／授業の手法など
「行政国家」という言葉があるように，現代国家の運営における行政の役割は多岐にわたっている。現在我が国で有効に適用されている2,200あまりの法律の多くが，行政活動に関する規範を定めている。「行政法」という名称の法律はないが，行政組織・行政活動・行政救済といった視点から様々な分析と検討が行われている。
また近年では，AIの発達に伴い，無人飛行機（ドローン）や自動運転の技術が向上しているが，最新技術の応用と行政政策は密接に関連している。総合政策・公共政策の考察において有益な行政法の知見を修得することを，本講座の目標としている。
今期はオンラインで授業を実施しますが，演習科目であることを踏まえて成績評価と講義運営は工夫して行います。
The role of administration in the operation of the modern state is diverse. It is the word "administrative state" that expresses the characteristic. A total of about 2,200 laws currently exist in Japan, the majority of which constitute the norms of administration. Although there is no law named "administrative law", we conduct various analyzes from the viewpoint of administrative organization, administrative activity and administrative remedy.
In recent years, with the development of AI, the technology of unmanned aerial vehicle (UAV, drone) and autonomous driving (Self-driving car) has improved. Therefore, effective use of new technology and administrative policy are closely related. The principal aim of this course is to learn useful administrative law knowledge in Policy Management considerations.
Since this class is an exercise subject, the grade evaluation and lecture management will be devised.

提出課題・試験・成績評価の方法など
基本的には，講義内で行う質疑応答と小テストに基づいて成績を評価する予定です。
(1) 質疑応答などの平常評価：３０％
(2) 小テスト（４回程度）：７０％
詳細は，履修者の人数に応じて確定します。
Basically, we plan to evaluate the grade based on the question and answer in the lecture and the score of the quiz.
(1) Contents of questions and answers in lectures: 30%
(2) Short examination (planned to be about 4 times): 70%
Details will be decided according to the number of students.

授業計画
第1回 イントロダクション／行政規制の必要性と合理性
[Introduction/ Necessity and rationality of administrative regulation]
初回講義の前半では，本講座の全体像と成績評価の基準について説明する。
後半では，行政法の概要を解説するとともに，指定教材の第１講に基づいて行政規制の必要性と合理性について講義を行う。なお，初回講義に関しては特段の予習は不要であるが，受講者は指定教材を毎回持参すること。
小型の六法を購入し使用することを推奨するが，本講座においては必携とはしない。
また，講座運営に活用するため，アンケートを実施する予定である。
In the first half of the lecture, I will explain the overview of this course and the criteria for grade evaluation.
In the second half of the lecture, I give the lecture on the outline of the administration law. Also, lectures will be given on the necessity and rationality of administrative regulation based on Chapter 1 of the designated teaching material. There is no need to prepare for the lecture before the first schedule, but you must bring the material each time.
It is recommended to purchase and apply the small statute book, but it is not necessary for this course.
In addition, we will conduct a questionnaire in order to utilize it for course management.
第2回 法律による行政の原理
[The principle of administration by law]
指定教材の第２講を題材に，法律による行政の原理を中心に講義を行う。
本講座で取り上げる各テーマは，指定教材を基礎に構成する予定である。予習にあたっては，指定教材を記述に沿って読み進めること。
演習科目であることを踏まえ，第２回以降は講義中に質疑応答も実施する。
Lecture focusing on the principle of administration by law on the subject of Chapter 2 of designated teaching material.
This lecture will proceed in order of teaching materials. If you are preparing, read through the materials in order.
As this is an exercise subject, questions and answers will also be given during the lecture from this day.
第3回 行政裁量
[Administrative discretion]
指定教材の第３講を題材に，行政裁量と裁判所の審査について講義を行う。
Lectures will be given on administrative discretion and the court's examination based on Chapter 3 of the teaching materials.
第4回 行政組織
[Administrative organization]
指定教材の第４講を題材に，行政の仕組みや権限行使の監督に関する講義を行う。
Based on Chapter 4 of the designated teaching materials, lectures will be given on the administration system and oversight of the exercise of authority.
As this is an exercise subject, questions and answers will also be given during the lecture from this day.
第5回 行政規範の制定
[Enactment of administrative code]
指定教材の第５講を題材に，法規範の概要や行政による規範制定について講義を行う。
Lectures will be made on the outline of the legal norms and the establishment of norms by the administration on the basis of Chapter 5 of the teaching materials.
第6回 行政処分・行政手続
[Administrative disposition and administrative procedure]
指定教材の第６講を題材に，行政行為・行政処分の意義と行政手続について講義を行う。
また，第６回までに説明した内容に基づいて中間的なまとめの解説を実施する。
Using Chapter 6 of the teaching materials, lectures will be given on administrative acts, administrative dispositions and administrative procedures.
In addition, based on the contents explained up to this day, we will interpret the intermediate summary.
第7回 ドローンと自動運転
[Unmanned aerial vehicle (drone) and Self-driving car]
第６回までに修得した行政法の基礎知識を土台として，第７回以降は行政政策における具体的な課題について検討していく。
今回は，交通政策における重要な課題の一つであるドローンと自動運転をテーマとする。前もって配付する関連資料を，各自で読んでおくこと。
Based on the knowledge of administrative law acquired up to the 6th lesson, we will examine specific issues in administrative policy after the 7th class.
This time, the theme is drone and autonomous driving, which are one of the important issues in transportation policy. Be sure to read the related materials distributed in advance.
第8回 行政処分・三面関係
[Administrative Disposal and Three-sided Relationship]
指定教材の第７講を題材に，廃棄物処理に関する規制の仕組みや三面関係に関する講義を行う。
第８回から第１１回では，必要に応じて行政上の最新の問題点や議論についても説明を展開する予定である。
Lectures on the structure of regulations concerning waste disposal and the three-sided relationship, with Chapter 7 as the subject.
In the 8th to 11th classes, we will explain the latest administrative problems and discussions as needed.
第9回 行政指導
[Administrative guidance]
指定教材の第９講を題材に，建設業者と周辺住民の利害調整について演習を行う予定である。
Using the 9th chapter of the teaching materials, we will practice the coordination of interests between the construction company and the surrounding residents.
第10回 給付行政
[Administration of bebefit]
指定教材の第１０講を題材に，生活保護の実施と介護保険の運営について演習を行う予定である。
Based on Chapter 10, we will conduct exercises on the implementation of welfare and the operation of long-term care insurance.
第11回 空き家・ごみ屋敷の対策
[Measures for vacant houses and garbage houses]
指定教材の第１２講を題材に，空き家・ごみ屋敷対策について演習を行う予定である。
We plan to do exercises about the measures for vacant houses and garbage houses on the subject of Chapter 12.
第12回 行政法・公共政策領域における最新の議論（電子政府など）
[The latest discussion in the field of administrative law and public policy (For example, e-government)]
通常授業日の最終回（第１２回）は，行政法・公共政策の分野における最新の議論を題材に設定する。
電子政府や都市のスポンジ化といった近時のトピックからテーマを選定する予定である。
The final session (12th) of regular school days will set the latest discussions in the fields of administrative law and public policy.
We plan to select themes from recent topics such as e-government and "Spongy urban area".
第13回 住民参加・住民投票
[Citizen participation and Referendum]
指定教材の第１３講を題材に，住民参加と住民投票について演習を行う予定である。
We will use Chapter 13 to conduct exercises on citizen participation and referendum.
第14回 小テストのフィードバック
[Feedback on the small exams]
オンラインシステム等を利用して実施した小テストについて，フィードバックを行う。
I plan to give feedback on the quiz conducted using the online system.
第15回 講座の総括
[Summary of the course]
この講座における行政法・公共政策に関する説明について，総括を行う。
We will summarize each subject of administrative law and public policy explained in this course.
15回目に相当するその他の授業計画
中間テストを第８回（11月15日)に実施するので必ず受験すること。
また，課題レポートの提出を必須とする。レポートの提出は，SFC-SFSのシステムにアップロードする方法による。課題の提出期日は１月とする予定であるが，第８回の講義時までに期限の詳細を確定して公表する。
An intermediate test will be conducted at the 8th lecture(November 15).
You must take this intermediate test.
You must also submit an assignment report. You can submit this report by uploading it to the SFC-SFS system. The submission date for this assignment will be January. About the details such as time limit, I will announce until the time of the 8th lecture.
